- A statement under penalty of perjury that you have a good‑faith belief the content was removed or disabled as a result of mistake or misidentification.
- Your full name, email address, and (optional) mailing address.
- A statement that you consent to the jurisdiction of the federal courts in your district, and that you will accept service of process from the person who submitted the original Takedown Notice.
Once a valid Counter‑Notice is received, Flomingo will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, the removed content may be restored.
6. Repeat Infringer Policy
In compliance with the DMCA, Flomingo enforces a Repeat Infringer Policy. A “repeat infringer” is any user who has received multiple valid DMCA Takedown Notices regarding their content.
- Flomingo tracks DMCA violations associated with each user account.
- Multiple valid takedown notices may result in temporary suspension, feature restrictions, or permanent account termination.
- Flomingo may also restrict the creation of new accounts by users who have been terminated for repeat infringement.
Flomingo reserves the right to take additional action in cases of severe, intentional, or malicious copyright violations.
7. Restoration of Content After Counter‑Notice
If Flomingo receives a valid Counter‑Notice, we will forward it to the original complainant. After the Counter‑Notice is delivered, the following rules apply:
- Waiting Period — Flomingo must wait 10–14 business days before restoring the content.
- Legal Action Window — During this period, the complainant may notify Flomingo that they have filed a court action to prevent the restoration of the content.
- Content Restoration — If Flomingo does not receive notice of a court action within the required timeframe, the removed content may be restored.
Flomingo is not required to restore content if doing so would violate any law, court order, or internal safety policy.
8. Misuse of the DMCA / Bad‑Faith Notices
The DMCA requires all parties to act in good faith. Submitting false, fraudulent, or bad‑faith notices or counter‑notices is a violation of federal law and may result in legal liability.
- Knowingly submitting a false DMCA Takedown Notice may result in damages, including legal fees, owed to the affected user.
- Knowingly submitting a false Counter‑Notice may also result in legal liability.
- Flomingo reserves the right to suspend or terminate accounts that abuse the DMCA process.
Flomingo may report fraudulent or malicious DMCA activity to the appropriate authorities or pursue legal action when necessary.
